Sorry, but this is simply not true.

"Copyright" does not equal "trademark." Both are intellectual rights, yet they differ significantly from each other. Copyrights usually have limited duration and do expire, for example 60 years after the author's death or 100 years after the work's first publication (these are examples). Copyrights usually don't require formal registration, and authors' economic rights don't need to be actively protected to maintain them.

Trademarks, on the other hand, do require formal registration and need to be actively maintained by the trademark owners. Failure to actively use the trademark or to enforce the registration in the event of infringement can lead to the removal of the trademark.

Saying "copyright does not lapse even if the owner does not prosecute those who violate it" is wrong as copyrights do expire no matter if owners sue anybody or not. However, this is true for trademarks, and trademark holder doesn't need to sue everybody who infringes on its use.

Private servers violate both copyright and trademark laws. Blizzard do not need to sue anybody to prevent copyright to expire. They do need to actively maintain their trademark though, and sending out C&D letters ensure that they don't lose the trademark as easily. (Fun fact: Blizzard have almost lost the DotA trademark to Valve once, and both companies settled out of court.)

If Blizzard wanted to do real damage, they would sue for lost revenue. 120.000 active accounts x 12 months x 12 EUR per month per account = 17.280.000 EUR, now that's a handsome number. :P

Awesome T-shirt, have ordered one. I still miss Nost dearly though.

For that they'd need to prove 120.000 active accounts would actually subscribe to retail if Nost wasn't here. I'm afraid they'd have easier time proving that if Legacy servers existed. So imagine a scenario in which Legacy are shit for some reason (cash shop extras or whatever) and they use its existence to shutdown vanilla private scene for good. Scary. For that they'd need to just win one court case and every private server would cease to function... or well... move to russia;P

Thats one more reason for me against Legacy personally, like I get it, we all wish that perfect vanilla server with 15k population to make world feel alive all the time, to have epic world pvp from time to time and all that without lag etc. I doubt blizz would make 15k capabble servers to begin with so I guess u'd have a lot of servers with like 2-3k cap and above that u'd have login queues to keep the latency low. I gotta admit, once Nost got a 13k and higher peak at the end it was bloody unplayable for like 5-7 hours, lag was just BRUTAL, I had cases in which I'd anchor stables as shadowmelded hunter and I'd see a rouge cap stables flag before I even saw him leave stealth (ok blame me for no flare but oh well). But Nost had that clustering technology in development and even without it... guys I hated lag but the moment we went to camp Emeriss... Lethon... and u had those MAAAAAAAAAAAAAAAAAAASSIVE battles in Hinterlands, I forgot about all the peaktimes lag in a split of second.

Anyways sorry for rambling but oh well <3 Nost.

Im not going to put nost on a pedestal like you have done, it had issues like most other private servers, and you dont need 15k pop to make a server feel alive. Great way to fuck up a game that was not designed for that many players at the same time, a few thousands is all you need at the at the same time on one server. Kronos 2 feels alive and i dont think it peaks more than 3-5k.

I will agree with the fact that it had issues, but virtually everything in this world is imperfect.

When we talk about it being "alive" we all have different meanings for it. The 3k online in Kronos feels dead to me, but that's because I prefer every zone being like a battleground.

I enjoy the constant PvP interactions. When I level on Kronos, interactions are rare and when a PvP battle comes along it is almost always when I am fighting a mob and had my guard down and health lowered. When that happens, it feels dead to me. However, on Nostalrius with the 8-10k online in my play times (the sweet spot) I was always turning my camera around to make sure there were no horde in the area, whereas on Kronos it felt like a waste of time to turn the camera since I saw players quite a bit more scarcely.

It always felt awakening to play Nostalrius because of the sheer amount of players looking for fights. It was volatile, but in a wonderful and complex way that added spice to the game.

Now, when it comes to PvE, yes, it was annoying to have 3 people fighting over a node or having 5 to a dozen fight over a quest mob, however Nost later hit that nail on the head by implementing Dynamic spawns for Nodes, and I'm sure they would have added it for quest mobs later on. That, in my eyes, WAS the only detriment I personally found to having a 10k online pop. I see 15k as being bad simply because the hardware wouldn't allow it and that it was slightly overboard.

I'll put Nost on a pedestal any day, best private server I had ever played on hands down.

A pop as high as pvp nost made 0 sense, since you could not see many players at the same time anyways because of draw distance (and how they lowered it to handle the pop). The pop also cased server lagg (which partly can be avoided by rewriting code + better hardware - but not everything can be fixed/improved by putting in new hardware. If the code is poorly written, no amount of hardware can save it), but the fact that you are 10+ people waiting on the same quest to finish it scripted event, spawns etc also speaks against such a huge payerbase online at the same time. Dont get me wrong, i liked nost even with its flaws, but i would hardly say servers like Kronos II feels dead.

The playerbase of kronos decreaded massively. Its maybe 2k online on peak nowadays.
