If I remember correctly, the law for artistic copyright, like warcraft, since this version is "outdated" and no longer supported, it is a legal grey area due to owner no longer supporting the content.
In US, it is still against copyright, but most courts won't care if the person/organization doesn't make profit as then it is technically under fair use laws and in a grey area which hasn't really come up as of yet for unsupported content. Most private server lawsuits for current content will go through as that product is still sold and supported by the company. The only private server projects that had a legal system go after them and lose were one's who started making money off the project.
TL/DR: legal grey area. As a consumer, you will not be in any trouble.
