Alright, so simple question, is it safe to download?

According to Norton Antivirus, yes.
And it isn't illegal to have the client or play on the private(pirate) server.

The Nost download is literally just a download of an old WoW client.

It's as safe as putting a 10 year old Warcraft CD in your computer.

It's safe. Just make sure to install to a different folder if you still have retail installed on your computer.

You don't really download Nostalrius. You download a 1.12 client. You can get that from anywhere, which may or may not be safe. If you don't trust one here, you can just as well try a different one. The game engine is not unique to a server. It just connects to a server. You're probably going to get the client from a well seeded torrent, which would be covered in negative comments if it was infested.
