You are confusing latency and bandwidth. Bandwidth is the upload/download rate you were talking about. Latency is the time it takes for a packet to travel from the source to the destination and has very little to do with upload/download rates.
Is the server peak time the same as the time people tend to get off work in your time zone? If so, your neighbors may be using a lot of bandwidth and slowing down your connection in the process.
You don't have a dedicated line to the internet. The ISP has a line to your neighborhood. This point of termination is a "node". It has a certain amount of bandwidth it can carry. This bandwidth is distributed to all the internet clients in the neighborhood (or that area of the neighborhood). If your neighbors are using too much, you get throttled too (in latency too, not just bandwidth).
This happens to me frequently in my neighborhood on weekdays after work hours and on the weekends. That's when people are home downloading porn.
