It's easy to downplay this topic if you're someone who lives in Europe, and no matter the time of day you get no delays. But for the 1/3 - 1/2 of the server's population who lives in the US, the delays get a little overbearing between 6pm and 11pm server time. I personally am on the east coast of the US with a solid computer and an excellent internet connection, and the delays still make the server border line unplayable for me roughly half the time I'm online. So for everyone saying it's not the server, I beg to differ.
A 5,000 player limit might be a little aggressive. Perhaps 7,000? I notice that 7,000 is right about where the delay starts to hit critical mass and really get exponentially worse.
I will grant you, a login cap of any number really sucks. Being in queue is not fun. However, it is a necessary evil. How many great private servers rise and fall because they try - entirely in vain - to attract and retain every last Vanilla player out there? The resources necessary to do that make it impractical. Trying to do so without the required resources had to the fall from grace of more excellent private servers than I care to remember.
In my humble opinion, It is better to have 6,000 - 7,000 players consistently and happily online, than to have 9,000 online where 4,000 are having a sub-par experience. Please, Nostalrius, you are great... do not fall into the same trap as the former greats.
I must take a moment to say what an awesome job you guys are doing. Of all the aforementioned great servers, this one has been my favorite by miles. The working quests, scripted events, dedication and demeanor of the development and GM teams is second to none. Please, keep up the excellent work.
