The relationship you describe between the AH and the Mailbox are completely different. You're comparing apples to donkeys and it is why such comparisons ought never to be made if you do not want them examined.
YOU solicit the scammer's auction by going to his auction.
The SCAMMER solicits YOU by putting things into your mailbox.
This is what makes it malicious, as it can affect the entire server despite them not performing any action other than automatically getting mail. The mailbox scam is able to hurt much more people much more easily and that is why it should be punished. It's simply in the best interest of doing the most good with the least harm.
