Safespotting should be bannable. They are getting easy honor by exploiting a bug that is the fault of the server.

They they outlawed safespotting in the ToU like 5 months ago, so technically he got a case, but as you already know most of us don't really care too much about it.

The safespotting they "outlawed" is stuff like sitting on the roof in cenarion hold or in gadget. Places where the guards aggro to you, but they can't physically get to you.

The guards can detect and engage them if they get within range of them. You're missing the context of how it looks in game. If these guys attacking people off the flight path got in range of a guard they would die. If the people in tanaris got in range of a guard while on the roof they wouldn't die.

Attacking someone outside the guards' range is not safespotting. Attacking someone inside the guards' range but using terrain to prevent them from reaching you is.

While I appreciate the pic, which is absolutely hilarious, I'm left thinking you didn't listen to what he said: namely, that you aren't in the aggro radius of any guards when you stand there in that spot. Now, I'm not saying he's correct, but its not entirely stupid (unless you think you should be attacked by guards when a hunter shoots someone who is mounted 40 yards from lhc and the mounted player runs into lhc).

For the record I did contact a GM at some point asking about whether the LOS (or whatever it is) abuse at Light's Hope Chapel is considered safespotting and thus bannable, and the GM confirmed that yes it is.
Don't ask for proof, I don't fraps all my activity on a 10 year old video game.
