The reality is that Blizzard does not write the scripts in private servers. It's custom made to mimic what was originally in the game. They also don't own any of the hardware, nor pay any of the bills. They didn't even create or have anything to do with the website databases that developers and players use. Pretty much the only thing they contribute at all for a server like this is an obsolete 10 year old client that they've long since stopped selling or support. They don't sell this client anymore. They haven't in 10 years.

The private servers however are hosted "somewhere else" to avoid this problem. In Europe, the copyright laws are much more sensible. This is why they can wank on these network sites but not the server.

And you definitely can't use it to play anymore through their servers, not without having it patched all the way up to current and forced to connect to realms running the newest version you don't want to play on. If you want to play Classic, they give no official or legitimate means to do so.
In other words, they need to go back to sucking on Activision's giant green dong and leave us original players alone. They've got their millions of heirloom wearing DF teleporting unicorn riding panda bears paying subs; they should be happy.

Someone else also posted that Blizzard did not code the private server, so they don't own the server. No, they don't own the server essentially, you are correct.
But all the the 3D models, animations, sprites, soundtracks, lore, client code, and ideas (yes, believe it or not, ideas can be copyrighted), and much more, which took a HUGE amount of time and money to make, does belong to Blizzard.
I mean, if I code a game using my own code but literally everything in it is from some other party, and then I let others play it for free, then the original developer, would understandably be frustrated with me.
Is this ethical or not? That's another topic, but please stop pretending like Blizzard doesn't own their own game.
