In fairness legitimate herbing would probably only go on for a short while. After that you are just playing with fire and that is hard to defend. Like you say, even if the person thinks that they are morally in the right, they will clearly benefit from the bug since there will be more nodes up than intended.

I wasn't online at the time, but the reports from those who were clearly stated that not all nodes were buggy. Thus you could conceivably find quite a few legitimate nodes before concluding or reading in chat that there is a massive bug going on. Especially if you are in a non-60 zone and not in /world. (Many actually aren't, or turns it off/tabs out of it when not lfg)

Take Gammelmor's story, make the person slightly more (un)lucky and you have a case for legitimate mining of at least more than a stack.

Might it be that the staff is undermanned and especially due to such high population, that we're not getting these reviews over banns?

Highly likely.

But in that case I'd rather just go after the big guys who really went to town and not bother with the people who got small amounts of non-lotus materials.

Banning people for relatively small amounts and not allowing a fair review is in my opinion exceptionally bad policy. (Seems from hearsay like 3 stacks of ore was enough for a ban, I find that amount small, especially if you have a ticket open)
