I don't think it's quite the difference whether you herbed every lotus spawn in throughout the world once and started farming other herbs always once. You knew by then that they had to be bugged for all of them being spawned and not picked already. I'm seriosly interested how this looked like.
In fairness legitimate herbing would probably only go on for a short while. After that you are just playing with fire and that is hard to defend. Like you say, even if the person thinks that they are morally in the right, they will clearly benefit from the bug since there will be more nodes up than intended.
I wasn't online at the time, but the reports from those who were clearly stated that not all nodes were buggy. Thus you could conceivably find quite a few legitimate nodes before concluding or reading in chat that there is a massive bug going on. Especially if you are in a non-60 zone and not in /world. (Many actually aren't, or turns it off/tabs out of it when not lfg)
Take Gammelmor's story, make the person slightly more (un)lucky and you have a case for legitimate mining of at least more than a stack.
